2.3 You expressly agree that the Company may, at its sole discretion, engage Subprocessors that comply with technical and organizational measures in a manner consistent with the applicable requirements of the Law, regulations and security standards provided for in this Privacy Policy and additional policies applicable in the Company.

2.4. If such Subprocessors are located outside the Swiss Confederation or the European Union or European Economic Area, the processing of personal data is carried out or will be carried out in accordance with applicable law.

2.5. Subprocessors are fully responsible for their actions and omissions, and for all obligations imposed on them. The Company shall not be liable if the information is disclosed as a result of a breach or non-compliance with the security by any such Subprocessors, or in case of non-compliance by the Subprocessors with the above requirements.

3. NOTIFICATION OF INCIDENTS

3.1. If the Company becomes aware of any violation of our security that led to the accidental or unlawful destruction, loss, alteration or unauthorized disclosure or access to (except for unsuccessful attempts or actions) of personal data of users in a system managed or otherwise controlled by us, we will immediately and without delay notify you in accordance with the procedure provided for by the relevant Law and Regulations.

3.2. The message will be sent to your email address. Only the User is responsible for providing us with an e-mail address and maintaining the validity and relevance of this address.

3.3. None of the data incident reports received from the Company can and will not be construed as confirmation of any error or liability in relation to data incidents.

4. RESPONSIBILITIES OF THE USER IN THE FIELD OF SECURITY

4.1. The User agrees that despite our security measures and data incidents, the User is responsible for the proper use of our services to ensure a level of security corresponding to personal data and to ensure the security of the system and devices used to access the website.

4.2. We are not obliged to protect your personal data that you have chosen to store or transfer outside the Company’s system and our Subprocessors.

5. USER RIGHTS IN RELATION TO PERSONAL DATA

5.1 You have the following rights in relation to your personal data:

1) The right to accessYou have the right to receive information from us about whether your personal data is being processed and, if so, to access such personal data.

2) Right to withdraw consentYou have the right to withdraw your consent to the processing of your personal data at any time. However, the withdrawal of your consent will not affect the lawfulness of the Company’s processing of such data based on the consent that was in force before the withdrawal.

3) The right to rectificationYou have the right to have your personal information accurate. For this purpose, you are obliged to inform us of any changes to the personal information provided to us by sending a request for rectification of your personal data if you believe that the personal data we hold is inaccurate or incomplete.

4) Right to restriction of processing You have the right to ask us to stop processing your personal data at any time.

5) The right to erasure If you ask us to delete all of your personal data, the Company will erase your personal data without undue delay (unless there are legitimate and legal reasons why we cannot delete certain of your personal data, in which case we will notify you). A request to stop processing your personal data or to delete your personal data will probably mean that you will no longer be able to use our services.
